Occupational Safety, Health & Working Conditions Code, 2020

Occupational Safety, Health & Working Conditions Code, 2020

Overview

The Occupational Safety Health and Working Conditions Code, 2020 replaces thirteen laws on safety, health, welfare and working conditions. In force since 21 November 2025, it covers factories, establishments, OSH Code contract labour rules, inter-State migrant workers, building workers, OSH Code registration and specified categories.

Applicability

OSH code applicability has no single uniform employee threshold for every provision of the Code. Applicability depends upon factors such as:
  • Nature of establishment
  • Number and category of workers
  • Whether the establishment qualifies as a factory
  • Contract labour engagement
  • Building and other construction work
  • Employment of inter-State migrant workers
  • Hazardous or specified processes
  • Other conditions prescribed under the Code and applicable rules
Therefore, OSH code applicability should be checked separately for each establishment and provision.
